Terms & Conditions
The trading names "The Beach Factory™", the "The Sleep Factory™" are operated by The Beach Factory Ltd. "We", "Our" and "Us" means any or all of the trading operations as the context requires. Unless stated otherwise these terms and conditions apply to all orders and your placing an order through any of Our web sites indicates acceptance of these terms and conditions.

Our operations are based in the UK and We can be contacted by telephone on (0800) 954 1927 (or +44 (0)20 3417 3869 from overseas), by post addressed to The Beach Factory Ltd, P.O. Box 28859, London, SW13 0YX, or by using Our online contact form.
All prices include VAT (where applicable) at the current rates. We accept MasterCard, Visa, Switch/UK Maestro, Delta, Solo and Electron. Your statement will show The Beach Factory Ltd. (www.beachfactory.com) as the payee. We also accept payment using PayPal.
If you wish to pay by cheque (UK sterling clearing only) or a money/postal order, please complete our online order form, print it and mail it to The Beach Factory Ltd, P.O. Box 28859, London SW13 0YX. Such payments should be made payable to "The Beach Factory" for the full amount of the goods ordered. Despatch of your order may be delayed until the funds have cleared.
We do not see or have any way of knowing card number information entered online. Credit/debit card information for orders placed via the internet is securely captured directly by our payment service provider SagePay (more information about SagePay's security) and is never viewable by Us. Your card details are transmitted in 128 bit encrypted sessions directly to SagePay's secure servers, who obtain payment authorisation from the card issuer and process the payment to Our bankers on our behalf. Sage pay is audited annually under the Payment Card Industry Data Security Standards (PCI DSS) and is a fully approved Level 1 payment services provider, which is the highest level of compliance.
You may give Us card details over the telephone if you prefer, but please do not send any card information by email as this is not a secure system. We destroy credit/debit card information given over the telephone immediately after a successful payment authorisation.
Different UK delivery options are usually available for you to select at checkout but their availability and actual speed of delivery may depend on operational constraints. Standard UK delivery is charged at a flat rate per order and We may use either Royal Mail First or Second Class post, Standard Parcel Service or courier at Our discretion. A next working day UK delivery service is normally available subject to the items being in stock and your order being received by Us before 11:45am on a working day. Please note that orders placed after 11:45am, or during a weekend or U.K. public holiday, will be processed on the next working day.
Postage and packing costs for delivery outside the UK is based on the shipping destination and value of the order. You can verify the exact amount in UK pounds sterling (GBP) that will be charged to your card before confirming an order online. Please note that where an international order includes bulky and heavy items We reserve the right to ship some or all of the order by surface mail. If this right is exercised We will advise you accordingly before despatch and you will be able to cancel the order for a refund. Furthermore certain items as specified on the website cannot be delivered outside the UK and we may therefore decline to process part or all of orders that include such items. Please contact Us if you want to confirm the shipping method and/or make an alternative arrangement beforehand, that may incur extra costs. Please note that you are solely responsible for any import/customs duties and taxes that your order may incur when delivery is to an address outside the UK.
We aim for a quick turnaround of your order and most orders are despatched from stock by the next working day. A despatch notice is normally sent by email. Occasionally and at Our discretion we may split a delivery to expedite its despatch.
If an item is not shown as being on back order and We cannot despatch it within 10 working days We will endeavour to correspond with you by email and then (when necessary) by telephone to advise the expected delivery date and take your instructions. You will have the opportunity to confirm or cancel your order or to accept a partial delivery or a substitution.
We take orders for products that are shown as being on back order on the basis that the delivery date is indicative only.
If you have any concerns or would like to confirm the actual availability of stock and a delivery date please telephone or contact Us.
We hope that you will be delighted with anything you buy from Us, but there may be occasions where a return or exchange is required and We are happy to do this within 14 days of receipt by you.

Our Invoice and Despatch note incorporates a Returns and Exchange Form on the reverse which should be completed and enclosed with any returned goods stating whether you prefer a refund or exchange. Further postage and packing costs at the rate for the destination are payable where you ask Us to exchange goods that We despatched correctly. If We cannot exchange the goods to your satisfaction We will refund the amount paid for the goods but not the postage and packing costs and have no consequent liability to you.
Returned goods must be despatched to Us at the address shown above within 14 days of receipt by you and you must take care of these goods while in your possession. They must be returned to Us unused, in the original packaging, with all tags and labelling intact and adequately protected against damage in transit such that they may be sold as new. We reserve the right to deduct up to 30% of the amount paid for goods that are returned to Us in an unacceptable condition from any refund.
For all returns you must cover the cost of delivery to Us. Please obtain your proof of postage as We cannot be held responsible if the returned goods are not received by Us.
You MUST contact Us for instructions BEFORE returning a product that you consider faulty. If We ask you to return the item and confirm the fault We will refund your return postage costs (up to the value of the cheapest service unless we have agreed otherwise).
Under UK Distance Selling Regulations an EU resident has the right to change their mind and cancel their entire order within 7 working days of receipt and without giving a reason. You must advise Us in writing if you are exercising this right and return all the goods to Us at your own expense. You may issue this written advice to Us by email, by contacting Us via the web site or by sending a letter to the address above.
Should you not return the goods to Us, you are legally required to make them available for collection and We are entitled to charge you our reasonable recovery costs.
We are committed to protecting your privacy. We use the information We collect about you and your order in accordance with UK law to process your order and for tax and verification purposes.
Along with your order details We collect personal information that includes your: name; address; telephone number and email address. Credit/debit card information for orders placed via the internet is securely captured and processed by Our payment service provider SagePay (more information about SagePay privacy) and cannot be viewed by Us at any time.
We may use your personal information for Our own marketing purposes but you may ask Us not to do so and where you have given express consent such marketing may occur by email. Apart from as needed to fulfil an order We will not divulge your personal information to third parties unless required by governing law or if there is a transfer or sale of some or all of Our business to new owners. Please note that the nature of the internet means that We do not control the location of computer servers that might be involved in processing your order or transferring emails and these might be located outside the EU.
Cookies are used by the shopping cart system to keep track of your cart contents once you select an item and remain on your computer only for the duration of your shopping session. Persistent cookies and our server logs are used to track the paths that visitors employ through our web pages and the search terms they have used. In common with other web sites your access is automatically logged by Our server against your computer's IP address.

available is provided in good faith but colour representation in particular may not be true to
life and the listing of an item does not guarantee that stock is available.
- You must ensure that the information supplied by you is correct before
proceeding to payment. We cannot accept responsibility for delays or delivery
problems and might not be able to process a refund if you give Us inaccurate
or incomplete information.
- Our website contains hyperlinks to third party websites. We do not
control such websites and take no responsibility for, and
will not incur any liability in respect of, their content. Our inclusion of
hyperlinks to such websites should not be taken to imply any endorsement of
the products, views, statements or information contained in such websites or the organisation.
- We will not be responsible for injury loss damage or expense you might suffer that is caused by any action or lack of action taken as a result of relying on information contained in this web site, any linked site, the product labelling and/or swing tags or as a result of a product failing to perform as expected.
- We will treat each order as an offer to purchase goods subject to these terms and conditions.
Our despatch of goods indicates acceptance of your offer in relation to those goods and the
creation of a binding contract.
- Various incentives including but not limited to special price offers or discounts
or free postage or cash backs may from time to time be given at our discretion.
If you accept an incentive that is subject to a minimum total order and the value of goods
returned for a refund then causes that total order to fall below the minimum value
then We shall be entitled to reduce the refund amount in order to reclaim the
value of the incentive.
- Information and media contained on Our website must not under any circumstance be
copied, lent, sold, hired out or otherwise circulated without Our prior consent.
- We may alter our terms and conditions at any time and without notice.
The conditions displayed on our website at the time of placing your order will
apply to your order.
- Any disputes arising from our terms and conditions will be settled in
accordance with English Law.
- Your statutory rights are not affected.
